iSoftBox Terms of Service

Introduction
These Terms of Service (“Terms”) constitute an agreement between you (“User,” “you,” or “your”) and Kevin Xia (“Developer,” “we,” “us,” or “our”) governing your use of the iSoftBox mobile application (“Application”) distributed through the Apple App Store.
By downloading, installing, or using iSoftBox, you agree to these Terms. If you do not agree to these Terms, do not use the Application.
Apple App Store Terms
Your use of the Application is also subject to the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement (“Apple EULA”). If these Terms conflict with the Apple EULA with respect to the Application, the Apple EULA governs. Apple is not a party to these Terms and is not responsible for the Application or its content.
License To Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on Apple-branded products that you own or control, as permitted by the Apple Media Services Usage Rules. You may use the Application for personal or professional photography.
Your Work
We claim no ownership of photographs, videos, scans, calibration frames, or other work that you create while using iSoftBox. You remain responsible for your work and for ensuring that its creation and use comply with applicable laws and third-party rights.
Safe And Appropriate Use
iSoftBox can raise display brightness, keep the screen awake, and produce sustained light. Use the Application responsibly:
- Avoid staring directly at a bright display for extended periods, and stop using the Application if it causes discomfort.
- Monitor device temperature and battery level during long sessions.
- Secure each device and any supporting stand, arm, carrier, camera, or telescope before use.
- Protect devices from falls, weather, condensation, scratches, excessive heat, and contact with equipment that could cause damage.
- Keep walkways and working areas clear during light painting or other activity in dark environments.
You are responsible for choosing a setup appropriate for your equipment, environment, and subject.
Photographic Results
Display brightness, color, uniformity, and spectral output vary by device, display technology, settings, viewing angle, temperature, and age. iSoftBox is not a calibrated laboratory light source, and we do not guarantee color accuracy, exposure accuracy, display uniformity, or suitability for a particular photographic or scientific workflow. Verify your setup and results before relying on them.
Restrictions On Use
You agree that you will not:
- Use the Application for an unlawful purpose or in violation of applicable laws or regulations.
- Reverse-engineer, decompile, disassemble, or attempt to derive source code from the Application, except to the extent such restrictions are prohibited by applicable law or permitted by licenses governing included open-source components.
- Modify, redistribute, sublicense, sell, rent, lease, or transfer the Application except as permitted by the Apple EULA or applicable law.
- Use the Application in a manner intended to damage, disable, or interfere with the Application or another system.
Intellectual Property
The Application, including its software, design, graphics, text, and other content, is owned by Kevin Xia or its respective licensors and is protected by applicable intellectual property laws. All rights not expressly granted under these Terms are reserved.
External Services
iSoftBox may access or open Apple’s App Store services to check for updates and to let you update, rate, or review the Application. Your use of those services is governed by Apple’s terms and policies. We are not responsible for the availability, content, or operation of third-party services.
Disclaimer Of Warranties
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Application will be uninterrupted, error-free, suitable for every display or workflow, or that any defect will be corrected.
Limitation Of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEVIN XIA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, EQUIPMENT, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION.
Our aggregate liability for claims arising from or related to the Application will not exceed the amount you paid for the Application, if any. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some provisions may not apply to you.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Kevin Xia from claims, damages, obligations, losses, liabilities, costs, and expenses arising from your unlawful use of the Application or your violation of these Terms.
Severability
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in effect.
Entire Agreement
These Terms, together with the Apple EULA and our Privacy Policy, constitute the entire agreement between you and Kevin Xia concerning the Application and supersede prior agreements concerning the same subject matter.
Changes To These Terms
We may modify these Terms from time to time. Changes become effective when the revised Terms are posted with an updated “Last Updated” date. Your continued use of the Application after revised Terms are posted constitutes acceptance of the changes.
